TERMS AND CONDITIONS OF SALE

The warranty, as set forth in this provision, is exclusively and in lieu of all other warranties, expressed or implied, including warranties arising from course of dealing or usage of trade. Seller makes no warranty, expressed or implied, of merchantability or fitness for any particular purpose.

Incidental or consequential damages, including negligence, loss or damages or other property, loss of profits or revenue, loss of use of property or equipment, claims of customers of the buyer, or for any special, indirect, incidental, or consequential damages whatsoever are not covered. Under no circumstances shall seller's liability exceed the purchase price of goods in respect of which damages are claimed.

Purchasers or users of a specific product must determine it's suitability for the intended application, use or purpose by appropriate and adequate testing, engineering and chemical analysis. Blue Ridge Fabricators, Inc. does not recommend any of its products for any particular use or application. The purchaser or user shall assume full responsibility for the adequacy and suitability for the intended use. Composition and suitability of materials used in the fabrication of products furnished by Blue Ridge Fabricators, Inc. is the sole responsibility of purchaser or user. Wear life of products may be limited by circumstances and conditions of use. Products should be inspected regularly and replaced as appropriate for operational and safety requirements in the prevention of injury or damage to persons or property.

All products are sold under warranty only pursuant to this terms and conditions of sale.
